IMAGE LICENCES & USAGE RIGHTS

All photographs remain the copyright of Peter Shortt Photos unless copyright is specifically transferred by a separate written agreement signed by the Photographer.
When you purchase an image, print or photography package, you are purchasing the rights specifically described in the licence below. You are not purchasing ownership of the copyright.
1. PERSONAL-USE LICENCE
This licence is intended for individual customers and families purchasing photographs for their own personal use.
Unless otherwise stated at the time of purchase, a Personal-Use Licence allows you to:
• download and store your purchased digital image;
• print the image for your own personal use, where printing rights are included with your purchase;
• share the image privately with family and friends;
• display the image in your home; and
• post the image on your personal, non-commercial social media accounts.
You may not:
• sell the image or copies of it;
• license or give the image to another business or organisation;
• use it for advertising or commercial promotion;
• supply it to a sponsor, brand or commercial partner;
• use it on a business website or business social media account;
• enter it into a competition as though you were the photographer;
• remove a watermark or copyright information;
• claim that you took or created the photograph;
• substantially manipulate or alter the photograph without permission; or
• use the photograph to create, train or contribute to an artificial intelligence or machine-learning system.
Price guide: Included with qualifying personal digital image purchases or as stated at the time of purchase.

2. SOCIAL-MEDIA-ONLY LICENCE
Where specifically offered, this licence allows the purchaser to use a purchased digital image on their personal, non-commercial social media accounts.
This licence does not include:
• printing rights;
• commercial use;
• advertising;
• sponsorship use;
• use by a club or organisation; or
• the right to transfer the image to another person or business.
The Photographer retains all copyright and ownership rights.

3. CLUB LICENCE
A Club Licence is required where a sports club, riding club, team, school, charity or other organisation wishes to use photographs for its own promotional or organisational purposes.
Unless otherwise agreed in writing, a Club Licence may permit use of specified photographs for:
• the club’s website;
• the club’s social media;
• non-paid promotional material;
• newsletters;
• match reports;
• event information; and
• reasonable internal and community promotion.
The licence does not automatically include:
• paid advertising;
• sponsorship advertising;
• resale of photographs;
• merchandise;
• use by third-party businesses;
• transfer of the images to sponsors; or
• use outside the agreed licence period or purposes.
The exact images, uses, duration and fee will be confirmed when the licence is purchased.
Price guide: Quoted individually according to usage, audience, duration and commercial value.

4. COMMERCIAL LICENCE
A Commercial Licence is required where photographs are used to promote, advertise or support a business, product, service or commercial activity.
Examples include:
• company websites;
• business social media;
• advertising;
• brochures and marketing material;
• paid social media advertising;
• sponsor promotions;
• product promotion;
• commercial publications; and
• promotional campaigns.
Commercial licences are priced according to factors including:
• the intended use;
• the number of images;
• the size of the audience;
• the media in which the image will appear;
• geographical coverage;
• duration of use;
• whether the use is exclusive or non-exclusive; and
• the commercial value of the campaign.
Unless expressly agreed otherwise, a Commercial Licence is non-exclusive, non-transferable and limited to the agreed purpose.
A commercial client must not give the image to another business, sponsor, agency or third party for further use unless that use has been specifically licensed.

5. EDITORIAL LICENCE
An Editorial Licence may be granted for use in:
• newspapers;
• magazines;
• news websites;
• editorial articles;
• event reports; and
• genuine journalistic coverage.
The licence will specify the permitted publication and, where appropriate, the duration and scope of use.
Editorial use does not automatically include advertising, sponsorship, advertorials or other commercial promotion.
Where practical and customary, image credit should be given as:

Price guide: Agreed individually depending on publication, circulation, image use and duration.

6. EXTENDED OR ADDITIONAL LICENCES
Additional rights may be purchased where a Client wishes to use an image beyond the licence originally granted.
Examples include:
• extending the duration of commercial use;
• adding additional media;
• allowing wider geographical use;
• use in paid advertising;
• use by sponsors;
• use on merchandise;
• exclusive-use arrangements; or
• transferring specific usage rights to another organisation.
An additional licence must be agreed before the new use takes place.

7. PHYSICAL PRINTS
The purchase of a physical print gives the purchaser ownership of that individual physical product only.
It does not give the purchaser ownership of:
• the copyright;
• the digital file;
• reproduction rights; or
• the right to make additional copies.
The print must not be scanned, photographed or otherwise copied for the purpose of creating further prints or products.
This does not affect any rights specifically granted under a separate digital image licence.

8. COPYRIGHT TRANSFER
Peter Shortt Photos does not normally sell or transfer copyright.
If a Client requires ownership of copyright, this must be specifically negotiated in advance.
Any transfer of copyright must be confirmed in a separate written agreement signed by Peter Shortt Photos.
Unless such an agreement exists, all copyright remains with Peter Shortt Photos.

9. UNAUTHORISED USE
Use of a photograph outside the licence purchased may constitute copyright infringement.
