By booking photography services, paying a booking fee, attending a shoot, purchasing prints/digital downloads, or accessing an online gallery, you (“the Client”) agree to these Terms and Conditions with Peter Shortt Photos (“the Photographer”).
1. BOOKINGS, FEES, AND CANCELLATIONS
● Booking Fee & Confirmation: Bookings are confirmed only upon receipt of the agreed non-refundable booking fee. This fee covers administrative costs and the reservation of dates, precluding other bookings.
● Payment Terms: Full balance payments for booked sessions are due on the date specified in your booking agreement. Digital downloads, prints, and products must be paid in full before delivery or release.
● Client Cancellations: Cancellations must be made in writing. The Photographer retains the non-refundable booking fee to cover reserved time and administrative costs. Cancellations made within 14 days of the scheduled shoot date require full balance payment to cover unrecoverable costs and loss of business.
● Rescheduling: The Photographer will make reasonable efforts to accommodate rescheduling due to severe weather or emergencies, subject to calendar availability.
2. COPYRIGHT, LICENSING, AND INTELLECTUAL PROPERTY
● Ownership: Under the UK Copyright, Designs and Patents Act 1988, full legal copyright and intellectual property rights in all photographs remain exclusively with the Photographer at all times.
● Personal License Grant: Purchased digital images grant the Client a non-exclusive, non-transferable license for personal, non-commercial use only (saving, private printing, and sharing on personal social media).
● Prohibited Uses: Clients shall not sell, sublicense, commercially display, alter (including heavy editing, filtering, or removing watermarks), or enter images into third-party competitions.
● AI & Machine Learning Restriction: Photographs must not be used to train, test, develop, or generate artificial intelligence (AI) models, datasets, or machine-learning systems without explicit written agreement.
● Infringement Fee: Unauthorised commercial use, screenshots, or removal of watermarks/metadata will incur a standard unauthorised usage fee equivalent to three times (3x) the commercial licence rate, plus administrative recovery costs.
3. COMMERCIAL AND PROMOTIONAL RIGHTS
● Portfolio & Marketing Rights: The Photographer reserves the right to use selected images for website portfolios, social media, advertising, competitions, awards, and promotional displays.
● Exclusivity & Non-Display Requests: If the Client requires complete privacy or non-publication of event/session images, this must be requested in writing prior to booking. The Photographer reserves the right to adjust commercial pricing to reflect the loss of portfolio marketing rights.
4. EVENT ORGANISER RESPONSIBILITIES & Under 18s
● Event & Under 18 Warranties: For sporting events, competitions, or private sessions involving individuals under 18, the booking Client or Event Organiser warrants that they have obtained all necessary permissions, venue authorisations, and parental/guardian permissions for photography.
● Client Indemnity: The Client or Event Organiser agrees to fully indemnify the Photographer against any third-party claims, legal costs, or disputes arising from a failure to obtain proper parental, venue, or attendee permissions.
● Incidental Capture: While reasonable steps are taken to respect opt-out requests, the Client acknowledges that complete exclusion of specific attendees in crowd scenes at public or large sporting events cannot be guaranteed.
5. PRINTS AND MADE-TO-ORDER PRODUCTS
● Consumer Rights Act Exemption: Personalised photographic prints, wall art, and custom photo products are bespoke and made-to-order. Under the Consumer Contracts Regulations, there is no right to cancel or return correct, undamaged products due to a change of mind.
● Damaged or Faulty Items: Faulty or damaged items must be reported in writing within 7 days of delivery with photographic evidence. Confirmed defects will be replaced or refunded in accordance with UK statutory rights.
● Reproduction Prohibited: Physical prints must not be scanned, re-photographed, copied, or reproduced electronically.
6. SPORTING EVENTS AND ANIMAL PHOTOGRAPHY
● Unpredictable Conditions: The Photographer relies on artistic discretion and does not guarantee specific single shots, poses, or coverage of every participant/animal. Results depend on weather, lighting, venue limits, and animal behaviour.
● Animal Control & Safety: Owners remain strictly responsible for the control, welfare, and safety of their animals at all times. The Photographer accepts no liability for damage or injury caused by animals. Shoots may be stopped immediately if safety is compromised.
7. LIMITATION OF LIABILITY
● Total Liability Cap: To the maximum extent permitted by UK law, the Photographer's maximum total financial liability for any claim, loss, negligence, or breach of contract shall be strictly limited to the total fees actually paid by the Client for the specific booking.
● Exclusion of Consequential Loss: The Photographer shall not be liable for indirect, economic, or consequential loss, missed opportunities, or third-party expenses.
● Data Loss & Equipment Failure: In the unlikely event of digital card failure, hardware malfunction, or loss of photographs before delivery, liability is limited strictly to a re-shoot or a pro-rata refund of fees paid.
8. FORCE MAJEURE AND SUBSTITUTION
● Unforeseen Events: The Photographer is not liable for failure or delay caused by events beyond reasonable control (e.g., sudden illness, injury, severe weather, transport disruption, or venue failure).
● Substitution: In the event of illness or injury, the Photographer reserves the right to supply an associate photographer of equivalent skill to complete the assignment, or provide a full refund of monies paid for unfulfilled services.
9. GOVERNING LAW AND SEVERABILITY
● These Terms and Conditions are governed exclusively by the laws of England and Wales. Courts in England and Wales hold exclusive jurisdiction over any disputes.
● If any individual provision is found invalid or unenforceable, all remaining provisions remain in full force and effect.
